CIVIL AND POLITICAL RIGHTS
Civil and political rights belong to the so-called "first generation" of human rights which are considered to be the most important rights and which distinguishes them from economic, social and cultural rights - rights of the "third generation". Civil and political rights include the right for life, prohibition of torture, prohibition of slavery, liberty and security of the person, procedural guarantees in civil and criminal trials (the rights of the accused), freedom of movement and protection against arbitrary expulsion, right to privacy, marriage, family life and rights of children, political rights, freedom of speech, equality and non-discrimination, etc.
Civil and political rights the most important and lasting achievements of the American and French revolutions in the late eighteenth century and of other bourgeois revolutions in the nineteenth and twentieth centuries. Basing on the doctrine of natural law according to which human beings are born free and equal in law in dignity and inalienable rights, civil and political rights are the legal expression of two different concepts of freedom. The first concept (the ancient democratic concept) states that individuals can achieve collective freedom through active participation in political decision-making process. The second modern concept declares that the individual freedom can be achieved by creating a private sphere for every human being which is to be protected against any undue interference by the state and other powerful actors, such as religions. In this sense, political rights are the individualistic expression of democracy, the civil rights of liberalism. In the various bills of rights adopted after the American Revolution 1776 and the French Declaration of the Rights of Man and the Citizen of 1789 both concepts of freedom are represented.
The rights of the accused are the typical example of civil and political rights. The rights of the accused include the right of the people to be secure in their persons, houses, papers, the right of any person not to witness against himself and the right not to be deprived of life, liberty or property without due process of law, the right to enjoy speedy and public trial by an impartial jury and be assisted by the counsel. All these rights are rather diverse but they limit the powers of the government and require that the government must be fair in its action s. It means that the government cannot take private property without paying a fair price, it must prove the guilt of the accused and cannot rely on coerced confessions. The rights of the accused prevent the government tyranny and correct the inherent imbalance between the power of the state and the power of individual.
The category of "political freedoms" which include freedom of expression, media, arts, assembly, association, etc serves both concepts of democratic and liberal freedom and thereby constitutes the link between civil and political rights.
